General

The Cubby Beds Instagram Giveaway (the "Sweepstakes") is a promotion run by Cubby Beds. The entry period (the "Sweepstakes Period") begins at 12:00 a.m. EST on August 12, 2026, and ends at 11:59 p.m. EST on August 19, 2026. All entries must be received during the Sweepstakes Period. Sponsor's computer is the official time-keeping device for the Sweepstakes.

Before entering, each entrant must review and agree to be bound by these Official Rules and Regulations ("rules"). By entering, entrants accept and agree to be bound by these rules and accept the decisions of the Sponsor as final and binding in all respects.

Sponsor

The Sweepstakes is sponsored by Cubby Beds (the “Sponsor”), 1580 Logan Street, Suite #500, Denver, CO 80203. The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Instagram, Meta Platforms, Inc., or any other external entity. All communication regarding the Sweepstakes, including requests to be removed from future Sweepstakes mailings, should be directed to the Sponsor at the address above (ATTN: Cubby Beds Marketing) or to Hello@CubbyBeds.com.

Eligibility

The Sweepstakes is open only to legal residents of the 48 contiguous United States, which excludes Alaska and Hawaii, as those are the states to which a Cubby Bed can be shipped, who are at least the age of majority in their state or territory of residence at the time of entry. The Sweepstakes is void in AK, FL, HI, NY, RI, and where prohibited or restricted by law. Anyone participating in or claiming a prize in violation of these rules will be disqualified.

The Sweepstakes is not open to the following persons: employees, agents, or representatives of the Sponsor, the subsidiaries and affiliates of the Sponsor, or employees, agents, or representatives of suppliers providing prizes or other materials or services in connection with this Sweepstakes, including promotional agencies and any creator or influencer partner promoting the Sweepstakes (collectively, the “Excluded Individuals”); immediate family members (parent, child, sibling, and spouse of each) of the Excluded Individuals; and any other persons with whom the Excluded Individuals reside.

Submitting the completed entry form is what registers your official entry. You must complete all required fields and acknowledgments to be eligible. Limit one entry per person and per email address for the Sweepstakes Period. Entries generated by script, macro, bot, or other automated means are void. The Sponsor may verify that a winning entrant followed the accounts named in step 1 before awarding the prize.

Alternative method of entry (AMOE), no follow, form, or subscription required: To enter without following on Instagram or completing the online entry form, hand-print your full name, complete mailing address, email address, phone number, date of birth, and Instagram handle (if any) on a 3" x 5" card, and include a signed statement that reads: "I have read and agree to the Official Rules, and I understand the Cubby Bed is a safety bed designed for children with complex medical or developmental needs." Mail the card in an envelope with sufficient postage to: Cubby Beds Instagram Giveaway, ATTN: Cubby Beds Marketing, 1580 Logan Street, Suite #500, Denver, CO 80203. Mail-in entries must be postmarked no later than August 19, 2026, and received no later than August 26, 2026. Limit one mail-in entry per person. Each eligible mail-in entry receives the same chance of winning as an online entry. Mechanically reproduced entries are void.

Selection and notification of winner

One (1) winner will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period. The drawing will take place on or about August 20, 2026, conducted by the Sponsor, whose decisions are final and binding.

The potential winner will be notified and announced by email only, within ten (10) business days of the drawing, using the email address provided at entry. Cubby Beds will email the winner only from Hello@CubbyBeds.com, and will never ask the winner to pay any fee or provide payment information to claim the prize. If a potential winner cannot be reached, fails to respond, or fails to claim the prize within three (3) business days of the first notification attempt, the prize may be forfeited and awarded to an alternate winner selected by random drawing. An unclaimed prize will not be awarded. The potential winner may be required to complete and return an affidavit of eligibility, a liability and publicity release, and an IRS Form W-9 before the prize is awarded and shipped, except where prohibited by law.

The winner’s name may be used in email communications and other promotional materials once confirmed as the winner, to ensure transparency in the selection process and to allow other participants to verify the legitimacy of the giveaway.

Prize and approximate value

One (1) winner will receive:

One (1) Dream Hub Accessory

The approximate retail value (ARV) of the total prize is $14,490 MSRP. The prize is awarded "as is" with no warranty or guarantee, either express or implied by the Sponsor. The winner may not substitute, assign, or transfer the prize, or redeem the prize for cash. The winner is solely responsible for all applicable federal, state, local, and other tax liabilities, including but not limited to sales and use taxes, excise taxes, income and withholding taxes, customs duties, fees, and like amounts in connection with the prize. The Sponsor is not responsible for any such taxes or expenses. Because the retail value of the prize exceeds the IRS reporting threshold, the winner must complete and return an IRS Form W-9 before the prize is shipped. The prize will not be shipped until a completed Form W-9 is received. The Sponsor will issue the winner an IRS Form 1099 for the retail value of the prize.

Odds of winning

The overall odds of winning depend on the total number of eligible entries received during the Sweepstakes Period.

Release, and consent to use of likeness, voice, and address

By entering the Sweepstakes, each entrant and winner agrees: (a) to abide by these rules and the decisions of the Sponsor, which are final and binding in all respects; (b) to comply with the terms and conditions of use of Instagram at all times and in all respects; (c) to release and hold harmless Instagram, Meta Platforms, Inc., the Sponsor, the subsidiaries and affiliates of the Sponsor, the franchisees and affiliated merchants of each of the foregoing, all prize suppliers, all agents or representatives of the foregoing, including without limitation their advertising and promotional agencies, and each of their respective officers, directors, and employees (collectively, the “Released Parties”) from any and all claims, liability, loss, or damage whatsoever arising with respect to the Sweepstakes or the awarding, receipt, possession, and/or use or misuse of any Sweepstakes prize, and further acknowledges that none of the foregoing persons have made, nor are responsible or liable for, any warranty, representation, or guarantee of a particular purpose thereof. Prizes awarded may carry their own product warranty, for which the Released Parties have no responsibility or liability if the product warranty has not been completed or coverage has expired; and (d) to consent to the use of his or her name, image, voice, likeness, city and state of residence, and/or photographs without compensation in any publicity or advertising carried out in any medium worldwide by the Sponsor and/or its advertising or promotional agencies, without limitation or further notification, and without providing compensation or intellectual property rights to the entrant, except where prohibited.

General conditions

Entries that are incomplete, mutilated, altered, reproduced, forged, counterfeited, or irregular in any way are automatically void. The Released Parties are not responsible for: (a) lost, late, delayed, illegible, inaudible, stolen, damaged, altered, destroyed, mutilated, misdirected, illegal, incomplete, or postage-due rule requests, entries, or prize claims; (b) lost, interrupted, or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone, or cable transmissions, lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software, or typographical, mechanical, telephonic, electronic, or network errors relating to or in connection with this Sweepstakes, including without limitation errors that may occur in the administration of the Sweepstakes, the processing of entries, the announcement of the prize, or in any Sweepstakes-related materials; or (c) any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes.

Entrants may be disqualified if automatic software is used in their favor, or if the Sponsor determines, in its sole discretion, that an entrant tampered with the entry process or participated in, induced, or caused in any way any false, fraudulent, or improper entries, including without limitation participating in a voting trust or voting agreement, and/or offering prizes or other inducements to members of the public, as determined by the Sponsor in its sole discretion. The Sponsor reserves the right, in its sole discretion, to select an alternate winner should the entry process appear to have been tampered with or manipulated in any way.

The Sponsor fully reserves the right, in its sole discretion, to cancel, suspend, terminate, or modify the Sweepstakes if the Sweepstakes is not capable of being completed as planned, including but not limited to infection by computer viruses or bugs, tampering, unauthorized intervention, force majeure, or technical failures of any sort beyond the reasonable control of the Sponsor, that corrupt or impair the administration, security, fairness, or proper play of this Sweepstakes.

No correspondence will be entered into except with potential winners.

Privacy

By entering the Sweepstakes and voluntarily providing your personal information as described in these rules, you agree to the collection and use of your personal information by the Sponsor and its representatives, promotional agencies, and marketing organization for the purpose of administering the Sweepstakes, including without limitation contacting entrants in respect of the Sweepstakes and disclosing the winner. Your personal information may be used for future promotions and marketing by the Sponsor, its affiliates, representatives, and promotional agencies, but will not be used for any other purpose, nor will it otherwise be disclosed to third parties unless required by law. To be excluded from all lists used by the Sponsor for future promotions and marketing, send a letter requesting removal to the Sponsor at 1580 Logan Street, Suite #500, Denver, CO 80203, ATTN: Cubby Beds Marketing. Governing law and disputes

This Sweepstakes and the terms and conditions in these rules are exclusively governed by and construed in accordance with the laws of the State of Colorado and the federal laws of the United States of America applicable therein. Any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration administered by the American Arbitration Association in the State of Colorado.

This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void in AK, FL, HI, NY, RI, and where prohibited or restricted by law. If any one or more provisions of these rules are held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the validity, effect, or enforcement of any other provision of these rules.
