Sensory Medical Inc. d/b/a Cubby Beds (“we,” “us,” “our”) designs and manufactures the Cubby Bed. We strive to continuously improve the Cubby Bed and to make the Cubby Bed financially accessible to more families. To do this, we are conducting a short survey to better understand the experiences of the families we have served and to conduct research to support coverage and reimbursement determinations by third-party payors. We hope you will be part of our research.

Why you are receiving this

You are receiving this communication because our records indicate that you or your child received a Cubby Bed (either directly or through an insurer or distributor) and/or you registered for our mailing list. We appreciate the trust you have placed in us and want to learn more about your experience. 

What we are asking you to do

We are inviting you to complete a short survey regarding your family’s experience with Cubby Beds, including:

• How you learned and acquired your Cubby Bed; 
• How the Cubby Bed has been set up and used in your home; 
• The impact the Cubby Bed has had on your child and family; and
• Any feedback or suggestions you may have. 

In addition to the short survey, we are also requesting your authorization to use and disclose your health information, as described in this form, to evaluate Cubby Bed's impact on your care experience in support of expanded third-party payor coverage and reimbursement.

Participation is entirely voluntary. You may choose not to participate, and doing so will have no effect on any warranty, service, or relationship you have with us.

Notice at collection – please read each section

By clicking the link to the survey and submitting your survey responses, you acknowledge that you have read, understood, and agree to the following: 

1. Collection of information 

We will collect the following categories of information in, or in connection with, the survey: 

• Contact data/identifiers – your name and mailing address, your child’s name 
• Demographic data – your zip code, child’s date of birth
• Commercial data – information relating to your Cubby Bed order, including when you ordered and received your Cubby Bed and whether insurance covered any part of the purchase 
• Marketing data – your preferences to receive our marketing communications and details about your engagement with them
• Sensitive personal information – you may choose to share information about your child’s health or medical condition that brought you to Cubby Bed and any impact Cubby Bed had on your child’s condition, disability, symptoms, or general health
• Other data –  while not specifically listed here, you may choose to share additional details, opinions, and feedback to describe your family’s experience with the Cubby Bed

2. Use + disclosure for research purposes

We will use information from this research to develop insights to improve product design, safety, and effectiveness and analyze trends in product use and customer experience. 

In particular, we will share your child’s name and date of birth with ResDAC, a Centers for Medicare and Medicaid Services (CMS) contractor that assists academic, non-profit, for-profit, and government researchers. ResDAC will use this information to match insurance claims in the CMS database and provide us with deidentified claims information to supplement our research. We may publish and share deidentified findings with third parties, including researchers, healthcare professionals, insurance companies, and the public. 

We also may share information for research purposes with service providers who are bound to confidentiality obligations and may not use your information for their own purposes—for example, those who assist us in operating the survey platform, data storage, analytics, and communications. We may deidentify any survey responses and use and share that deidentified information for any lawful purpose.

We will not publish identifiable information about you or your child. We will not sell your or your child’s personal information to any third parties. 

3. Use + disclosure for marketing purposes

Below we will separately ask for your consent to use survey responses and related research data and findings for marketing and promotional purposes. This may include:

• Sharing your feedback (either attributed to you by first name, last initial, and state, or anonymously, based on your selection below) on our website, social media channels, advocacy communications with insurance companies or healthcare professionals, or advertising materials;
• Developing case studies or success stories about families who have used a Cubby Bed;
• Communicating with you about new or related products, services, promotions, or news; and
• Personalizing marketing communications to you based on your product use and preferences.

You may opt out of marketing communications at any time by clicking “unsubscribe” in any email we send or by contacting us at Hello@CubbyBeds.com. 

4. Future + undetermined uses

Our research and business needs may develop over time, and we may wish to revisit survey responses and related research data and findings for future uses. Any future uses will be consistent with the general purposes described in this form (i.e., research, product development, and marketing), and will be subject to our Privacy Policy.

5. Expiration/data retention 

This consent shall continue in effect unless and until earlier revoked by you in accordance with the revocation process described in section 7. We will retain your survey responses and related research data and findings for as long as reasonably necessary to fulfill the purposes described in this consent form, or as required by law. You may request deletion of your personal information at any time by contacting us at Hello@CubbyBeds.com, subject to any legal obligations we may have to retain certain records.

6. HIPAA

In certain circumstances, the personal information covered by this consent may include “protected health information” governed by the Health Insurance Portability and Accountability Act (“HIPAA”). By consenting below, you acknowledge and agree to the use and disclosure of any such protected health information as described herein. You further acknowledge your understanding that the information disclosed may be subject to redisclosure by the recipient and no longer protected by HIPAA. 

7. Your rights

You may revoke your consent by informing Cubby Beds in writing at Hello@CubbyBeds.com. You understand that your revocation will be effective upon receipt, except to the extent that Cubby Beds or any other permitted third party has acted in reliance on this authorization.

Depending on where you reside and whether particular information is subject to HIPAA, you may have certain additional rights regarding your personal information, such as the rights to:

• Access or obtain a copy of the personal information we hold about you;
• Correct inaccurate information; 
• Request deletion of your information; and
• Opt out of certain uses, including marketing communications

We do not use sensitive personal information for purposes beyond those to which you consent. Please see our Privacy Policy for further details about your rights, right to appeal, right to use an authorized agent, and how to exercise your rights. 8. Information about your child

To the extent you provide information about your child, you represent that you are the parent or legal guardian of that child and that you have the authority to provide such information on the child’s behalf. We will treat information about your child with particular sensitivity and will not use it in any individually identifiable manner in external-facing materials without your separate, explicit written consent.
